Terms of Service

1. Who operates Adkemist

Kamil Fachtali, carrying on business as THE FATALI PARTNERS, operates Adkemist.

Adkemist is a sole proprietorship (entreprise individuelle) based in Québec, Canada. In these terms, “we” and “us” mean that operator, and “you” means the person or organisation using the service.

2. Accepting these terms

Creating an Adkemist account, or using the service, means you accept these terms and the privacy policy. If you are agreeing on behalf of a company or a client, you confirm you are allowed to bind them.

If you do not accept these terms, do not use the service.

3. Eligibility and your account

Adkemist is a business tool for people who buy advertising. You must be at least 18 and legally able to enter into a contract.

You are responsible for your sign-in credentials and for what happens under your account. Tell us at support@adkemist.io if you think someone else has access to it.

4. What the service does

Adkemist connects to a Meta advertising account you choose, with read-only permission, and syncs its performance data. From that data it produces summaries, diagnostics, comparisons, alerts, reports and answers from Kiro, our analysis assistant.

The permission we request from Meta is read-only. Adkemist does not create, edit, pause, resume, publish or scale campaigns, ad sets, ads, budgets or targeting. Every change to your advertising happens in Meta Ads Manager, made by you.

The service depends on data Meta reports. Where Meta reports nothing for a metric, Adkemist shows nothing rather than a zero, and where it cannot support a conclusion it says so.

5. Recommendations are not decisions

Everything Adkemist produces is information and decision support. A recommendation to scale, cut, refresh or investigate is a suggestion based on the data available at that moment, and you decide whether to act on it.

We do not promise any advertising outcome. Nothing in the service is a guarantee or forecast of return on ad spend, cost per acquisition, conversion volume, revenue, profit or growth. Advertising results depend on your offer, your market, your creative, your pricing, Meta’s auction and delivery, and factors none of us controls.

Adkemist is not a financial, legal, tax, accounting or investment adviser, and nothing it produces is professional advice of that kind.

6. What you stay responsible for

Adkemist reads figures. It cannot tell you whether an ad is lawful in your market, and it does not review your creative content.

7. Connecting an account you have the right to connect

When you connect a Meta ad account, you confirm that you own it or are authorised by its owner to give a third-party tool read access to it. If you run accounts for clients, that authorisation is between you and them, and getting it is your responsibility.

The same applies to any other source you connect, such as a Shopify store, and to any business data you enter about someone else.

9. Meta and other third parties

Adkemist depends on Meta. Meta controls what data it reports, how its API behaves, how long an access token lasts and whether an integration stays available. If Meta changes or withdraws something, parts of the service may change or stop working, and that is outside our control.

We use third-party providers to run the service. They are listed in the privacy policy, which explains what each one receives.

You can disconnect Meta from Adkemist at any time, from your settings or from Meta’s own business integrations page.

10. Plans and payment

Adkemist does not charge for access today, and the service does not collect payment details.

Paid plans may be introduced. If they are, the price, the billing period and the cancellation and refund terms will be shown to you before you are asked to pay, and no existing account will be charged without agreeing to them first.

11. Intellectual property

The Adkemist software, interface, name and brand belong to us. Using the service does not transfer any of that to you.

Your data stays yours: your advertising figures, the business context you enter, and the reports and analyses produced from them. We use them to provide the service to you, as the privacy policy describes, and we do not use them to train machine-learning models.

12. Suspension and termination

You can stop using Adkemist at any time, disconnect Meta, and ask us to delete your data through the deletion process.

We may suspend or close an account that breaches section 8, that puts the service or other users at risk, or that we are required to close by law. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.

13. Liability

The service is provided as it is. We do not warrant that it will be uninterrupted, error-free, or that the data Meta reports through it is complete or accurate.

To the extent the law allows, we are not liable for lost profit, lost revenue, lost advertising spend, lost data or lost business opportunity, or for any indirect or consequential loss arising from your use of the service or from a decision you took after reading it.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred Canadian dollars.

Nothing here limits liability that cannot be limited by law, including liability for fraud, for death or personal injury caused by negligence, or under mandatory consumer protection legislation.

14. Changes to these terms

We may update these terms. The date at the top changes when we do, and for anything that materially affects you we will give notice by email before it takes effect. Continuing to use the service after that means you accept the new version.

15. Governing law

These terms are governed by the laws of the Province of Québec, Canada, and the courts of Québec have jurisdiction over any dispute.

If you are a consumer, this does not take away the protection of the mandatory laws of the country you live in, including your right to bring a claim there.
